Welcome to Indian Registration Portal. These Terms and Conditions ("Terms") govern your use of our website and services. By accessing or using our platform, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our platform.

1.1. Intermediary Role & Platform Nature

Indian Registration Portal is a privately operated platform connecting users with independent third-party experts. We do not provide government services directly, nor do we offer legal advice. The platform acts solely as a facilitator. References to entities like Directorate General of Foreign Trade (DGFT) or Food Safety and Standards Authority of India (FSSAI) are for informational purposes regarding the services offered by experts.

1.2. User Responsibilities

  • Users are solely responsible for evaluating the competence, qualifications, and suitability of any third-party expert they choose to engage through the platform.
  • Users must provide accurate, complete, and current information when requested by the platform or by an engaged expert.
  • Users are responsible for ensuring their compliance with all applicable laws, regulations, and requirements related to the services they seek. This includes verifying information on official government portals like samadhaan.msme.gov.in or DGFT.
  • Any disputes, service failures, deficiencies, or issues arising from the engagement with an expert are solely between the user and the expert. Indian Registration Portal is not a party to such disputes.

1.3. Fees & Payments

  • Service fees for expert assistance are negotiated and agreed upon directly between the user and the chosen third-party expert. Indian Registration Portal is not involved in setting or collecting these service fees.
  • Any applicable government fees for registrations, licenses, or applications must be paid by the user directly on the respective official government portals (e.g., DGFT, Udyam Portal, FSSAI's FoSCoS). Indian Registration Portal does not collect government fees.

1.4. Intellectual Property

All content on this website, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is the property of Indian Registration Portal or its content suppliers and is protected under Indian intellectual property laws and international conventions. Unauthorized use, reproduction, modification, distribution, or transmission of any content is strictly prohibited. References to entities like the Ministry of Corporate Affairs are for contextual information only.

1.5. Limitation of Liability

Indian Registration Portal, its owners, employees, and affiliates disclaim all liability for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from: (i) your access to or use of or inability to access or use the platform; (ii) any conduct or content of any third party (including experts) on the platform; (iii) any content obtained from the platform; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage. Our total liability in any matter arising out of or related to these terms is limited to INR 100. This limitation applies even if a remedy fails of its essential purpose. References to entities like FSSAI are for contextual information regarding services for which liability is disclaimed.

1.6. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India. References to entities like the Directorate General of Foreign Trade are for contextual information only.

1.7. User Conduct and Prohibited Uses

You agree not to use the platform for any unlawful purpose or any purpose prohibited under this clause. You agree not to use the platform in any way that could damage the platform, the services, or the general business of Indian Registration Portal.

  • You further agree not to use the platform:
    • To harass, abuse, or threaten others or otherwise violate any person's legal rights.
    • To violate any intellectual property rights of Indian Registration Portal or any third party.
    • To upload or otherwise disseminate any computer viruses or other software that may damage the property of another.
    • To perpetrate any fraud.
    • To engage in or create any unlawful gambling, sweepstakes, or pyramid scheme.
    • To publish or distribute any obscene or defamatory material.
    • To publish or distribute any material that incites violence, hatred, or discrimination towards any group.
    • To unlawfully gather information about others.

1.8. Privacy Policy

Your use of the Indian Registration Portal platform is also governed by our Privacy Policy, which is incorporated herein by reference. Please review our Privacy Policy to understand our practices regarding the collection and use of your personal information.

1.9. Amendments to Terms

Indian Registration Portal reserves the right to amend these Terms at any time. We will notify users of any material changes by posting the new Terms on this platform or through other communication channels. Your continued use of the platform after such changes have been posted will constitute your acceptance of the new Terms.

1.10. Termination

Indian Registration Portal may terminate or suspend your access to the platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

1.11. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

1.12. No Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Indian Registration Portal's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

1.13. Force Majeure

Indian Registration Portal shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond Indian Registration Portal's reasonable control, including, without limitation, mechanical, electronic, or communications failure or degradation, natural disasters, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, or strikes.

Overview & Eligibility

The IEC is a 10-digit code mandatory for all import/export entities, issued by the DGFT (Directorate General of Foreign Trade). Eligibility requires a valid PAN, bank account in the firm’s name, and registered address (Directorate General of Foreign Trade).

Application Workflow

  • DGFT Portal Registration: Create a user profile at dgft.gov.in, linking PAN and DSC (Digital Signature Certificate) (DGFT).
  • Form Filing: Complete and submit the e-IEC application (Service → “Manage IEC”) with requisite documents (PAN, bank proof, address proof) (DGFT).
  • Validation: DSC validation and bank account verification occur online; allow 3–5 business days for IEC issuance.
  • Modifications: Use the same “Manage IEC” module to update email, mobile, or bank details (DGFT).

Fees & Renewals

  • Application Fee: Nil for IEC (DGFT does not levy a fee) (DGFT).
  • Validity: IEC is lifetime; updates require no fee but must comply with DGFT timelines.

Overview & Eligibility

MSME registration under the Udyam scheme grants access to subsidies, credit schemes, and preferential procurement under MSMED Act, 2006 (MSME).

Registration Steps

  • Aadhaar & PAN Linking: Enterprise owner’s Aadhaar and PAN must be linked.
  • Udyam Portal Entry: Visit udyamregistration.gov.in, complete Form UAM with investment and turnover details (Lean MSME).
  • Verification: OTP is sent to the registered mobile linked with Aadhaar; upon verification, Udyam Registration Number is generated immediately.

Fees & Compliance

  • Fee: Nil for MSME registration.
  • Annual Update: No need for renewals; update turnover/investment if crossed thresholds.

Overview & Applicability

FSSAI license (Form A/B) is mandatory for all Food Business Operators under FSS Act, 2006 and Regulations 2011 (FSSAI).

Application Process

  • FSSAI Portal: Register on foscos.fssai.gov.in and log in.
  • Form Selection:
    • Form A: turnover ≤ ₹12 lakh (registration)
    • Form B: turnover > ₹12 lakh (license) (FSSAI).
  • Document Upload: Identity/address proof, business premises proof, photo, layout plan, food safety management plan.
  • Fee Payment: Online via net banking; fees vary by state and turnover slab.
  • Inspection & Issuance: Local FSSAI authority may inspect premises before granting license.

Validity & Renewal

  • Registration (Form A): valid for 5 years; License (Form B): 1–5 years as chosen (FoSCoS).
  • Renewal: Apply at least 30 days before expiry via the same portal.

Overview & Legal Framework

Governed by Trade Marks Act, 1999 and Rules 2017, a registered trademark protects brand identity for 10 years, renewable thereafter (Intellectual Property India).

Filing Procedure

  • TM-A Form: File TM-A online at ipindia.gov.in with mark representation, class of goods/services, applicant details (Intellectual Property India).
  • Search Prior Marks: Conduct clearance search to avoid conflicts.
  • Examination & Publication: Examiner reviews application; if accepted, mark is published in the Trademark Journal for opposition period (4 months) (Intellectual Property India).
  • Registration Certificate: If no opposition or after successful opposition, certificate issued.

Fees & Renewals

  • E-Filing Fee: ₹4,500 for individuals/startups/SMEs; ₹9,000 for others per class (Intellectual Property India).
  • Validity: 10 years from date of application; renew for successive 10 years (form TM-12).

Patents are governed by Patents Act, 1970 and Patents Rules, 2003/2023; grant term is 20 years from filing (Intellectual Property India).

Application Steps

  • Form 1 & 2: File application (Form 1) and provisional/complete specification (Form 2) via ipindiaonline.gov.in (Intellectual Property India).
  • Publication: Automatic after 18 months (or early publication request via Form 9).
  • Examination: Request examination (Form 18) within 48 months of priority date.
  • Compliance: Respond to examination reports; pay statutory fees (First Schedule).
  • Grant & Post-Grant: Issue of patent; annual renewal fees from year 3 onwards.

Small Entity: Lower statutory fees; others pay full fees as per First and Second Schedule (Intellectual Property India).

Overview & Applicable Law

Companies Act, 2013 requires SPICe+ e-Form for incorporation, DIN allotment, PAN/TAN allotment, and EPFO/ESIC registration (Ministry of Corporate Affairs).

Incorporation Workflow

  • DIN & DSC: Obtain Digital Signature Certificates and Director Identification Numbers.
  • SPICe+ Part A: Name reservation (Form INC-1) via mca.gov.in (Ministry of Corporate Affairs).
  • SPICe+ Part B: Incorporation details, MOA/AOA attachment, subscriber details.
  • Certificate Issuance: MCA issues Certificate of Incorporation with CIN, PAN, and TAN.

Post-Incorporation Compliance

  • Statutory Registers: Maintain registers of members, directors, charges.
  • Annual Filings: File annual returns (Form MGT-7) and financial statements (Form AOC-4) within prescribed timelines.

b. User Responsibilities

c. Our Responsibilities (as Service Provider)

  • Provide timely updates on application status.
  • Submit applications and documents meticulously on the client’s behalf after due verification.
  • Maintain strict confidentiality and security of client data as per our Privacy Policy.

d. Limitations of Service

  • We do not control government portal downtimes, processing delays by authorities, or final decisions on application approvals/rejections, which are at the sole discretion of the respective government bodies.
  • We are not liable for any adverse outcomes due to changes in government policies, procedures, or unannounced portal maintenance.

e. Estimated Service Timelines

  • Digital Signature Certificate (DSC): Typically 1-2 working days.
  • Letter of Undertaking (LUT): Typically 2-3 working days.
  • Government e-Marketplace (GEM) Registration: Typically 3-5 working days.
  • Note: Timelines are indicative and subject to client's timely document submission and government processing speeds.

f. Modification of Service Terms

We reserve the right to update these service-specific terms. Clients are advised to review them periodically on our platform. Continued use of services after changes implies acceptance.

What is DSC?

A Digital Signature Certificate (DSC) is a secure digital key issued by a certifying authority (like eMudhra, Sify, Capricorn, etc.) to verify the identity of the certificate holder. It is the digital equivalent of a physical signature but much more secure, as it is encrypted.

Purpose of DSC

  • To authenticate the identity of an individual or organization in digital communications.
  • To sign documents online, ensuring they are legally valid and tamper-proof.
  • To log in and file forms securely on portals like GEM, MCA, DGFT, Income Tax, GST, etc.

Types of DSC We Provide

  • Class 3 DSC (for individuals or organizations)
    • ✔️ Used for e-Tendering, GEM, MCA, ITR filing, and more.
    • ✔️ Valid for 1 or 2 years depending on the option selected.
  • DSC for DGFT
    • ✔️ Specifically designed for importers/exporters registered under DGFT.
    • ✔️ Required for digital submission on DGFT portal.

What is LUT?

LUT (Letter of Undertaking) is a declaration filed by exporters with the GST department to export goods or services without paying IGST (Integrated GST). It’s a legal way for exporters to claim zero-rated export benefit without blocking capital.

Purpose of LUT

  • To enable tax-free exports for businesses and freelancers.
  • Avoid payment of IGST at the time of export.
  • Maintain legal compliance with GST Rule 96A.

Who Should File LUT?

  • Any GST-registered exporter of goods or services.
  • Freelancers or agencies offering services abroad.
  • SEZ units doing zero-rated supplies.

Documents Required

  • PAN and GST Certificate
  • IEC (Import Export Code)
  • KYC of Proprietor/Partner/Director
  • Previous year export invoices (if applicable)
  • Authorization Letter (if filing via consultant)
  • DSC of authorized signatory (Class 3 DSC required)

LUT Filing Process

  1. Client provides GST login and documents.
  2. Drafting of LUT with legal terms.
  3. Upload on GST Portal.
  4. Submit with DSC authentication.
  5. Download LUT Acknowledgment Copy.

Validity

LUT is valid for 1 Financial Year. It must be renewed before 1st April every year.

The Government e-Marketplace (GEM) is an online platform for public procurement in India. It aims to enhance transparency, efficiency, and speed in public procurement of goods and services.
